Elderly Abuse
Elderly Abuse can de defined as any act, failure to act, or incitement to act done willfully, knowingly, or recklessly through words or physical action which causes or could cause mental or physical injury or harm or death to an elderly resident of a nursing home including verbal, sexual, mental/psychological, or physical abuse.
Involuntary seclusion by separation from others against the resident's will or the will of the resident's legal representative is also elderly abuse.
Elderly abuse also includes mental or psychological elderly including humiliation, harassment, and threats of punishment, deprivation or intimidation.
Elderly abuse can also be physical abuse of the elder resident including without limitation hitting, slapping, pinching, and kicking as well as controlling behavior through corporal punishment. It can also be sexual abuse of the elder resident such as any touching or exposure of the anus, breast, or any part of the genitals without the voluntary, informed consent of the resident. Sexual abuse carries the intent to arouse or gratify the sexual desire of any person and includes, but is not limited to, sexual harassment, sexual coercion, or sexual assault.
Verbal abuse is also part of elderly abuse and can take the form of any oral, written, or gestured language that includes disparaging or derogatory terms to an elderly resident or within the resident's hearing distance, regardless of the resident's age, ability to comprehend, or disability.
Healthcare fraud can include duplicate billings for the same medical service or device, overmedication or undermedication, inadequate care when bills are paid in full and poorly trained, poorly paid, or insufficient staff or crowding at the care facility carried out by unethical hospital personnel, and professional care providers.
