Medical Malpractice and Nursing Home Care

Medical care and treatment that breaches acceptable medical standards of care and causes injuries or death constitute medical malpractice.

Medical malpractice is professional negligence by act or omission by a health care provider in which care provided deviates from accepted standards of practice in the medical community and causes injury to the patient.

Elder abuse and nursing home neglect also constitute medical malpractice. While most nursing homes provide complete, competent care, there are instances when the quality of care is not up to standards, and as a result malpractice occurs. When dealing with malpractice in the care provided in nursing homes, general neglect is the most common manner of abuse.



Nursing Home Neglect Includes:

If your elder relative has been injured as a result of medical negligence, you must file a medical malpractice claim within a limited time period called the "statute of limitations," and it varies from case to case. You may have more or less time to file the claim depending on your particular situation. You must prove four elements: (1) a duty of care was owed by the nursing home; (2) the nursing home violated the applicable standard of care; (3) the person suffered a compensable injury; and (4) the injury was caused in fact and proximately caused by the substandard conduct. The burden of proving these elements is on you.
